1. Acceptance of terms
By accessing or using Airsup ("the Service") operated by Airsup, a US corporation, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.
2. Description of the service
Airsup is an AI-powered platform that helps hardware startups describe their manufacturing needs and connects them with suitable factories. The Service includes:
- An AI intake conversation to understand product and manufacturing requirements.
- Automated factory matching and outreach.
- A messaging layer to facilitate communication between startups and factories.
Airsup acts as a platform intermediary only. We do not manufacture products, guarantee factory performance, or guarantee that any match will result in a successful business relationship.
3. Accounts and registration
- You must provide an accurate email address and complete onboarding truthfully.
- You are responsible for keeping your account secure. Do not share your login link.
- You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
- One person or company may not maintain more than one account for the same role (startup or supplier).
- We reserve the right to suspend or delete accounts that violate these Terms.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable laws.
- Post false, misleading, or fraudulent information about your company or product.
- Attempt to reverse-engineer, scrape, or extract data from the platform systematically.
- Harass, threaten, or abuse other users or Airsup staff.
- Use the Service to contact factories outside of the platform to circumvent future fees.
- Upload content that infringes third-party intellectual property rights.
- Introduce viruses, malware, or other harmful code.
5. AI-generated content
Airsup uses large language models (currently Anthropic Claude) to process your inputs and generate responses, briefs, and match recommendations. You acknowledge that:
- AI-generated content may contain errors or inaccuracies and should not be relied on without review.
- Airsup does not guarantee the accuracy or completeness of AI-generated factory matches or outreach messages.
- You are responsible for verifying any information before entering into a business relationship with a matched factory.
6. Intellectual property
All rights, title, and interest in the Airsup platform, including software, design, trademarks, and AI systems, are and remain the exclusive property of Airsup.
These Terms do not grant you any right to use the Airsup name, logo, or branding without our prior written consent.
7. Your content
You retain ownership of all content you upload or submit ("User Content"), including product descriptions, files, and messages.
By submitting User Content, you grant Airsup a non-exclusive, worldwide, royalty-free license to use, process, store, and display your content solely to operate and improve the Service. We will not sell your User Content to third parties.
You represent that you own or have the necessary rights to submit your User Content, and that it does not infringe any third-party rights.
8. Confidentiality between parties
When Airsup facilitates a match, basic profile information is shared between the startup and the factory. Each matched party agrees to treat shared information as confidential and not to disclose it to third parties without consent. Airsup is not responsible for how matched parties handle each other's information after introduction.
9. Payment
The Service is currently free to use. If we introduce paid features in the future, we will provide clear notice before any charges apply and will not charge you without your explicit agreement.
10. Disclaimers
Airsup does not endorse any factory listed on the platform. You conduct due diligence at your own risk.
11. Limitation of liability
Some jurisdictions do not allow limitation of liability for certain types of damages. In those jurisdictions, our liability is limited to the fullest extent permitted by law.
12. Indemnification
You agree to indemnify and hold harmless Airsup and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party rights.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access at any time for violation of these Terms or for any other reason, with or without notice.
Sections 6, 7, 10, 11, 12, and 14 survive termination.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions.
Any dispute arising from these Terms or the Service will first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, the dispute shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA) in Delaware, except that either party may seek injunctive relief in a court of competent jurisdiction.
Class action waiver: You agree that any dispute resolution will be conducted on an individual basis and not as part of a class, collective, or representative action.
15. International users
European Union / EEA users
If you are in the EU or EEA, nothing in these Terms limits your rights under mandatory consumer protection laws in your country of residence. The limitation of liability in Section 11 applies only to the extent permitted by applicable EU law.
China users
If you are accessing the Service from the People's Republic of China, you are responsible for ensuring your use complies with applicable Chinese laws and regulations. By using the Service, you consent to your data being processed outside of China in accordance with our Privacy Policy.
16. Changes to these terms
We may update these Terms from time to time. We will notify registered users by email for material changes at least 14 days in advance. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
